Legislation Could Affect Process Servers

NEW YORK, NY -- Bill A8287, which would change workers compensation laws, was introduced in the New York State legislature. The bill would keep independent contractors from being assessed premiums as employees. Under current laws, the State Insurance Fund auditors define independent contractors as employees. The New York State Trial Lawyers Association supports the bill and many in the industry also feel that the bill could affect process servers and other expert witnesses at trial. Currently, many process servers work as independent contractors but under current rules, carriers can classify them as employees.
