Service of Process Necessary for Photo Speeding Tickets

PHOENIX, AZ -- Starting this week, any notices sent from photo enforcement companies must state the fact that recipients do not need to identify the driver in the picture and do not need to respond to the notice. Many customers have not been aware of the fact that ignoring the notices means that the photo enforcement companies need to send a process server to serve an official summons in the event of a violation. If the summons is never served correctly by a process server or alternative service, the ticket is not valid. If a summons is served by process servers or by alternative service, it is as valid as a ticket issued in person by a police officer. Some photo enforcement companies have been using vague language on initial mailed notices to make drivers believe that the mailed notice is legally binding or a summons, but it is not. A new law signed by Governor Jan Brewer requires the mailed notices to be more upfront about their legal status.
